Foreign pensioners who move to Portugal are exempt from paying tax on their pensions. There are two reasons for this exemption on foreign pensions. The first has to do with the Agreement on Double Taxation celebrated between the country of residence and the country of origin. This treaty grants the country of residence the right to tax foreign pensions, rather than have them taxed in the country of origin. The second reason has to do with the Personal Income Tax regime for Non-habitual residents. According to this regime, the Portuguese state exempts foreign pensions from taxation. However, for that to apply the foreign pensioners must have acquired the status of Non-habitual Residents in Portugal and transferred their pensions to the country. This tax benefit can only be enjoyed for a limited period of ten years, however. Following this period, taxes will be levied progressively.
